Please note that in line with our clients' commitments to the CMA, only certain former leaseholders qualify for a refund.
Former leaseholders who met either of the following criteria when the subject property was owned by them, could be eligible for a refund if they made payments for any of the items detailed below:
- you owned the property directly (i.e. it was registered in your name(s) so not owned via a company, trust or charity) and you occupied it; or
- you owned the property directly (i.e. it was registered in your name(s) so not owned via a company, trust or charity) but it was let for any period during your ownership, and you owned no more than 2 residential properties which you had let or intended to let - this includes any properties you may have owned via a company, trust, charity or other arrangement.
In line with our clients’ commitments to the CMA, no refunds will be made to former leaseholders who met either of the following criteria when the subject property was owned by them:
- the property was owned via a company, trust, charity or any other arrangement so that it was not registered in the name(s) of a natural person, or
- you did not occupy the subject property and you owned 3 or more residential properties (including the subject property and any residential properties owned indirectly via a company, trust, charity or other arrangement), and at least 3 of these properties had been let for any period during your ownership or were intended to be let.
If you fall within the first set of criteria detailed above, our client will refund the following to you:
- any ground rent you have paid to us over and above the level of the initial ground rent which was payable under the lease at the time that it was entered into (e.g. If the initial ground rent in your lease was £100 per annum and following the first rent review you paid £200 per annum our client will refund £100 for each year in which you paid £200 in respect of ground rent)
- the appropriate portion of any payments of interest you have paid to us in respect of the late payment of any such increased ground rent; and
- the appropriate portion of any administration charges you have paid to us as a result of us having to send payment reminders in respect of the late payment of any such increased ground rent.
